On August 18, 2023 (88 FR 56702), the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a Notice in the Federal Register (FR) to solict public comment and concerns on its next step of Hazardous Materials: Frequently Asked Questions (FAQs) before finalizing the Incident Reporting FAQs on their website: https://www7.phmsa.dot.gov/about-phmsa/phmsa-faqs On March 22, 2022, PHMSA announced an initiative to convert historical letters of interpretation (LOI) applicable to the Hazardous Materials Regulations that have been issued to specific stakeholders into broadly applicable FAQs. On December 9, 2022, PHMSA finalized the first set of FAQs and announced the topic for the next FAQs. This notice contains the second set of FAQs concerning the requirements for incident reporting and notification are outlined in 49 CFR Sections 171.15 and 171.16. Interested persons are invited to submit comments on or before September 18, 2023. Comments received after that date will be considered to the extent practicable.
