NRC Inflation Adjusts Maximum Penalities

On January 15, 2020 (85 FR 2445), the Nuclear Regulatory Commission (NRC) published a notice in the federal register to announce a revision to its Enforcement Policy to address the requirements of the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. The 2015 Improvements Act amended the Federal Civil Penalties Inflation Adjustment Act (FCPIAA) of 1990, and now requires Federal agencies to adjust their maximum civil monetary penalty annually for inflation. Specifically, the maximum Civil Monetary Penalty (CMP) amount found in Section 8.0, “Table of Base Civil Penalties” Table A of the NRC Enforcement Policy is being updated to $300,000 for a violation of the Atomic Energy Act (AEA) of 1954, as amended, or any regulation or order issued under the AEA. This action is effective on January 15, 2020.
