EPA Intents Revising Clean Water Rule

On March 06, 2017 (82 FR 12532), the Environmental Protection Agency (EPA) and the Department of the Army (Army) published a notice in the federal register announcing their intention to review and rescind or revise the Clean Water Rule. It is important that stakeholders and the public at large have certainty as to how the Clean Water Act (CWA) applies to their activities. Through new rulemaking, the EPA and the Army seek to provide greater clarity and regulatory certainty concerning the definition of “waters of the United States” and “navigable waters” consistent with the principles outlined in an Executive Order issued by the President of the United States on February 28, 2017 and the agencies’ legal authority.
